A Sole Arbitrator was appointed by the Hon’ble Bombay High Court under Section 11 of the Arbitration and Conciliation Act, 1996. Further, the Company has filed its Statement of Claim and subsequently CSD filed an application under Section 16 of the Arbitration and Conciliation Act, 1996 challenging the jurisdiction of the Arbitral Tribunal on the ground that no valid Arbitration Agreement existed between the parties. The Sole Arbitrator by an Order dated September 26, 2026, passed under Section 16 of the Arbitration and Conciliation Act, 1996, held that no Arbitration Agreement exists between the parties and, consequently, that the Arbitral Tribunal lacks jurisdiction to continue the Arbitral proceedings. The Order is limited only to the issue of jurisdiction and does not adjudicate the merits of the Company's claims.
