The Adjudicating Authority has held that the imported goods did not qualify as Technical Grade Urea as it did not meet the criterion of Technical Grade Urea as biuret content exceeded 0.80% and appeared to fall correctly under Fertilizer Grade Urea and ordered confiscation of the goods under Sections 111(d) and 111(m) of the Customs Act, 1962. The Authority has held that the goods did not meet the applicable specifications for Technical Grade Urea and were therefore not covered under the free import category. Consequently, the goods were held to be prohibited goods and liable for confiscation under Sections 111(d) and 111(m) of the Customs Act, 1962. Penalties were also imposed under Sections 112(a)(i) and 114AA of the Customs Act, 1962. The Company submitted that the principal basis for the allegation was the Biuret content of the imported Urea. The Company explained that the consignments were tested by independent surveyors at the load port and the test certificates generally reported Biuret content within the applicable limit for Technical Grade Urea. The Company disputed the reliance placed by the department on post-clearance factory test results, since the same were generated using an in-house rapid testing method and not in accordance with the sampling and testing procedure prescribed under IS 1781:2022. The Company further submitted that no representative samples had been drawn by Customs while the goods were under Customs control and no contemporaneous Customs/CRCL test report was available.
